ONE. OBJECT:

This privacy policy (referred to below as the “Privacy Policy”) regulates the data protection rules and security measures put in place by Bitoon Games, SL.

Users are therefore recommended to carefully read these rules before accessing Bitoon Games, SL's pages, and to view them regularly. If they do not agree with these terms, Users should not make use of Bitoon Games, SL's web pages.

Bitoon Games, SL, as the owner and controller of the personal data automatically obtained through its web pages, undertakes to meet its obligations as a processor of those data pursuant to Organic Law 15/1999 of 13 December on the Protection of Personal Data (referred to below by its initials in Spanish, “LOPD”) and Royal Decree 1720/2007 of 21 December, approving the Regulations Developing Organic Law 15/1999 of 13 December on the Protection of Personal Data (referred to below by its initials in Spanish, “RPDP”). In their activities and use of Bitoon Games, SL's web pages, Users in turn accept the obligations arising from the LOPD, RPDP, and any other developing regulations, including the recommendations and instructions issued by the Spanish Data Protection Agency.

THREE. DATA PROTECTION

By providing their personal data, Users authorise Bitoon Games, SL to store that information in one or more automated files to aid their access to the web pages' content; manage or improve the content and/or services offered on them; study the use made of the content and services the web pages offered; keep the web pages in correct working order and send them advertising, i.e. communications that directly promote the web pages or the purchasing of products or services from Bitoon Games, SL or third parties with whom Bitoon Games, SL has commercial agreements. Bitoon Games, SL accepts responsibility for these files.

Bitoon Games, SL will inform web page Users of whether or not it is compulsory for them to provide the data requested on the forms they must fill in to register on the web pages and access the content and/or services offered. When these data are provided, this information will be shown using visual signs, such as pop-ups, asterisks or symbols alongside the compulsory information or any similar method. Users' refusal to provide these personal data, or the entering of incomplete or erroneous data may prevent their access to the content and/or services offered on Bitoon Games, SL's web pages or affect the service they provide or their correct working.

Users are responsible for the authenticity and accuracy of the data provided, which may be modified as necessary by sending an e-mail to info@bitoon.com. Bitoon Games, SL will not be liable for any consequence or damage that may arise from the User not complying with this obligation.

Bitoon Games, SL's web pages use cookies. Cookies are data files that the web page sends to the User's computer when he/she visits the website. Companies use cookies for many purposes. For example, when Users return to one of Bitoon Games, SL's web pages after having registered, the cookies provide the web page with information so it can remember who they are. Users may configure their computer to warn them when one of these files is going to be generated or prevent it entirely. Security measures are reviewed regularly to consider the possibility of introducing new technologies or methods of protection. However, the User must take into account that although Bitoon Games, SL does everything in its power, no security measure is completely perfect or infallible.

Pursuant to the Information Society Services and E-Commerce Act 34/2002 of 11 July, Bitoon Games, SL will not send the Users of the web pages any kind of advertising, commercial or promotional information without Users' authorisation or prior consent. Bitoon Games, SL informs Users that they may exercise their right to object to receiving such advertising information. In order to do so, they must follow the instructions given when their consent is requested or send written notice to info@bitoon.com. Whenever Bitoon Games, SL sends advertising it will also provide Users with the possibility of cancelling such communications through specific mechanisms.

With regard to the personal data of Users who are minors under the age of 18, Bitoon Games, SL guarantees that this information will not be used for purposes inappropriate to their ages and will particularly take into account the age, understanding, awareness and maturity of this group and will never ask for information about their families' financial situation or personal data. Bitoon Games, SL will also allow parents or legal guardians to exercise the legal rights of access, deletion, objection and rectification of the data and warns such Users that they should speak to their parents or guardians before providing any information of this kind. In the case of children under 14 years old, Bitoon Games, SL tries to prevent minors from directly providing personal data by contacting their parents or guardians directly and confirming by e-mail that the data have been provided by adults. In spite of the foregoing, Bitoon Games, SL may request written consent from parents or guardians at any time to verify their awareness and authorisation of their children's access to Bitoon Games, SL's web pages.

FOUR. ON-LINE COMMUNITY

Bitoon Games, SL's web pages, on-line services or games offer access to an on-line community aimed at all groups of the public, known as “BasketDudes”. Before they can access the BasketDudes site, Bitoon Games, SL asks users to provide an e-mail address. Bitoon Games, SL uses that address to send the user an electronic message in which it informs the user that he/she has registered on the BasketDudes site so that Bitoon Games, SL may verify the user's existence and consent to registration. This e-mail address is associated with the account user's name.

Bitoon Games, SL will also use this account to send information from time to time about the company's products and services, Bitoon Games, SL's web pages, and promotional information from any third party with which Bitoon Games, SL has commercial agreements.

FIVE. USE OF THE INFORMATION

The personal data on Bitoon Games, SL's web pages, on-line services or games are included in one or more automated files that have been registered with the Spanish Data Protection Agency.

Bitoon Games, SL will use the data gathered through Bitoon Games, SL's web pages for the following purposes:

Account activation to access specific areas of Bitoon Games, SL's web pages, on-line services or games;

Sending commercial and/or promotional messages from Bitoon Games, SL or third parties with which it has agreements;

Sending information about Bitoon Games, SL's products, goods, services and/or web pages, on-line services or games;

Updating Users' profiles on Bitoon Games, SL's web pages, on-line services or games;

Follow-up and monitoring of Users' use of Bitoon Games, SL's web pages, on-line services or games;

Sending this information to official public or administrative authorities when an unlawful act has been committed in the manner allowed by the applicable regulations;

Complying with a public duty;

Any other purposes described more specifically in the Terms and Conditions of Use or in other specific terms and conditions applicable to certain products or services.

If Bitoon Games, SL transfers part of its business or in cases of a merger or conversion of companies, Bitoon Games, SL will be authorised to transfer the personal data to the new group of companies insofar as is allowed by the applicable regulations. In any case, the User expressly accepts the inclusion of his/her personal data in files owned by Bitoon Games, SL or any of the companies in its company group. The User also recognises that Bitoon Games, SL may entrust third parties with processing his/her data to better provide the service offered through Bitoon Games, SL's web pages within the legal requirements of the LOPD and the RPDP for the purposes set forth herein.

SIX. NOTE TO PARENTS

The internet offers a world of fun opportunities for children. It is essential for children's parents and elders to be involved and guide them so that children have a safe internet experience, so we invite adults to share the browsing experience with children. We especially advise parents/guardians to access Bitoon Games, SL's web pages at any time and join in the games and fun on offer there.

In spite of the foregoing, Bitoon Games accepts no liability for its users' actions and the truthfulness of their data, whether users who are children under 18 years old or their parents and guardians.

SEVEN. TERM

Bitoon Games, SL may modify this data protection policy at any time in order to make commercial improvements or adapt to new regulations and/or instructions published by the Spanish Data Protection Agency, so Users should regularly check it.
